Welcome to NotesXP! These Terms of Service ("Terms") govern your use of our application ("App"). By accessing or using NotesXP, you agree to these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By using NotesXP, you confirm that you are at least 13 years old (or the required minimum age in your jurisdiction) and have the legal capacity to agree to these Terms.

2. Description of Services

NotesXP provides AI-powered study tools, including:

  • AI-generated study notes from textbook photos and PDFs
  • AI-generated podcasts, flashcards, mind maps and quizzes

Some features require a paid subscription, managed through Apple’s App Store.

3. User Responsibilities

You agree to:

  • Use the App only for lawful purposes.
  • Not upload content that is illegal, harmful, or violates intellectual property rights.
  • Not attempt to disrupt the App’s functionality (e.g., hacking, reverse engineering).
  • Not access NotesXP’s private API by unauthorized means.
  • Not interfere with or disrupt the App, servers, or networks connected to the App, including transmitting any malicious software.
  • Not create accounts using automated methods such as bots or scrapers.

Violation of these Terms may result in termination of your access to the App.

4. AI-Generated Content Disclaimer

NotesXP leverages AI models to generate study materials. While we strive for accuracy, AI-generated content:

  • May contain errors or inconsistencies.
  • Should not be considered a substitute for professional or academic resources.
  • Is provided "as is" without warranties of any kind.

You are responsible for verifying the accuracy of AI-generated content before using it for academic purposes.

5. Subscription and Payment

  • Some features require a subscription, managed via Apple’s App Store.
  • Payments are processed by Apple. We do not store or handle payment details.
  • Subscription plans automatically renew unless canceled before the renewal date.
  • No refunds are provided except as required by applicable laws or Apple’s policies.
  • Uninstalling the App does not cancel your subscription.
  • We reserve the right to modify subscription fees at any time.

6. Data Collection and Privacy

  • We do not require user accounts.
  • We collect anonymous analytics data to improve the App.
  • Uploaded content (textbook photos, PDFs) is processed temporarily and not stored permanently.

7. Intellectual Property

  • NotesXP and its AI-generated content are protected by intellectual property laws.
  • You retain ownership of any content you upload, but you grant us a limited license to process it for AI-powered study features.
  • You may not reproduce, distribute, or modify the App’s AI-generated content for commercial purposes.
  • The NotesXP name and logo are trademarks of NotesXP and may not be copied or imitated without permission.

8. Limitation of Liability

To the maximum extent permitted by law:

  • NotesXP is provided "as is" without warranties.
  • We are not responsible for inaccuracies in AI-generated content.
  • We are not liable for any direct, indirect, incidental, or consequential damages resulting from your use of the App.

9. Modification or Termination of Service

  • We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.
  • We may terminate your access if you violate these Terms.
  • Termination of service does not entitle you to refunds.

10. Third-Party Services

  • The App may contain links to third-party websites or services that we do not control.
  • We are not responsible for third-party content, interactions, or transactions.

11. Indemnification

You agree to defend, indemnify, and hold NotesXP harmless from any claims, liabilities, damages, or expenses arising from:

  • Your use of the App.
  • Your breach of these Terms.
  • Your violation of any third-party rights.

12. Territorial Restrictions

We reserve the right to limit the availability of the App based on geographic locations.
